Appeal Process

How to appeal an administrative penalty.

Any individual or business imposed with an Administrative Penalty (AP) has the legal right to appeal the decision to the Licence Appeal Tribunal (LAT). The appeal must be filed within 15 calendar days from the date the AP notice is received. 

How to Appeal 

1. To exercise your right to a hearing, please visit the LAT's website to obtain a Notice of Appeal form. 

2. TSSA requests for a copy of the appeal letter to be sent to appeals@tssa.org to facilitate necessary follow up. 

After your appeal is filed, the LAT will reach out to you directly with information regarding your appeal and the next steps in the process.

Note: 

  • Sending your notice of appeal to TSSA does not count as filing an appeal. Appeals must be filed with the LAT.
  • Legal representation is not required for LAT appeals. However, an AP recipient may choose to retain a lawyer for guidance, particularly if the matter is complex. 

Joint Submissions to Licence Appeal Tribunal 

In certain cases, an AP recipient and TSSA may reach a mutual agreement on a revised penalty amount prior to the hearing date. This is referred to as a joint submission. LAT may take these joint submissions into consideration.

Court Appeals

Processes exist to object to the decision made by the LAT. Information is available at Application and hearing process - Tribunals Ontario
